Terms and Conditions
Introduction
These Terms and Conditions govern the provision of services by J & D Funeral Directors, to our clients. By arranging a funeral service with us, you agree to the terms set out below.
Definitions
"We/Us/Our" refers to J & D Funeral Directors.
"You/Your" refers to the client or person responsible for making arrangements with us.
"Service(s)" refers to the funeral services provided by J & D Funeral Directors.
Arrangements and Estimates
Upon agreeing to engage our services, an arrangement meeting will be held to discuss and plan the details of the funeral. Following this meeting we will provide you with either a written or verbal estimate depending on arrangements made.
PASSING THE ACCOUNT TO A THIRD PARTY FOR PAYMENT
It is sometimes the case that a solicitor or insurance company will pay our invoice directly. Please advise us if you are planning to pass the invoice onto a third party for payment.
FUNERAL PLAN REDEMPTION
It is important to check whether the person who has passed away had a funeral plan in place. If there is a plan in place, we will talk you through what will be covered by the plan and where there may be additional fees to pay. We will provide an estimate of any additional costs to you, and you, as our client will be liable for these costs. Our costs may exceed the amount of cover offered by the funeral plan and in that case you will be liable for any additional fees.
SETTLEMENT OF ACCOUNT
We will prepare the final funeral account up to 3 days after the funeral has taken place. We will show the value of the payments made prior to the funeral, and the balance of the account will be due within 7 days of the date of this invoice unless otherwise previously discussed.
LATE PAYMENT CHARGES
If the final payment is not received within 14 days of the invoice date, we reserve the right to charge interest on the overdue amount. This interest will accrue daily from the date the payment was due until the date payment is made, at an annual rate of 1.5% above the base lending rate of the Bank of England. This interest will be charged both before and after any court judgment. Additionally, failure to make timely payments may result in us taking further action to recover the outstanding amount, including legal proceedings, for which you will be liable for any associated costs.
MONEY ON ACCOUNT
We reserve the right as we deem appropriate to ask for up to 100% of the cost of the Funeral Fees up front before the funeral takes place. We reserve the right not to proceed with the funeral unless fees have been paid in full.
Deposit and Payment Terms
Deposit: A deposit covering third party’s expense is required within 48 hours of the arrangement meeting unless other arrangements have been discussed. The deposit confirms your commitment to our services and allows us to commence preparations for the funeral service.
Final Payment: The final bill will be issued 3 days after the funeral service has been conducted. This bill will reflect the actual charges incurred, including any additional costs or adjustments made during the preparation and execution of the services. The deposit paid will be deducted from the total amount due.
Payment Methods
We accept payments by bank transfer, cheque, Cash. All payments should be made using the payment details provided on the invoice.
Cancellation Policy
If you need to cancel the funeral arrangements after the deposit has been paid, you must notify us in writing as soon as possible. Depending on the timing and the extent of work already undertaken, a cancellation fee may apply. The amount of this fee will be determined on a case-by-case basis and may include any non-refundable expenses we have incurred.
Changes to Arrangements
Should you need to make any changes to the funeral arrangements after they have been confirmed, you must notify us immediately. We will do our best to accommodate any changes, but please be aware that additional costs may be incurred as a result.
Limitation of Liability
Our liability to you shall be limited to the amount paid for our services. We will not be liable for any indirect, incidental, or consequential damages arising from the provision of our services, except in cases of gross negligence or wilful misconduct.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the Scottish courts.
Complaints
If you are dissatisfied with any aspect of our service, please contact us in writing within 14 days of the funeral service. We take all complaints seriously and will work to resolve any issues as swiftly as possible.
Data Protection
We are committed to protecting your privacy and handling your personal data in accordance with the Data Protection Act 2018. Any personal information you provide to us will be used solely for the purpose of providing our services and will not be shared with third parties without your consent, except where required by law.
Entire Agreement
These Terms and Conditions constitute the entire agreement between you and J & D Funeral Directors regarding the provision of funeral services. No other terms, whether express or implied, shall apply unless agreed upon in writing by both parties.
